Can an unsigned contract be legally binding?
A recent decision of the High Court has illustrated that in certain circumstances an unsigned contract can nevertheless be legally binding.
On the facts of this particular case the parties had reached agreement on all the terms of a contract between them, and although they had not signed it, they had commenced carrying out its terms which resulted in the contract being held to be legally binding.
