Abolition of Statutory Dismissal and Grievance Procedures
You may be aware that the statutory dismissal and grievance procedures will be abolished from 6 April 2009, so can we ignore them completely from this date on?
Unfortunately not. There are complicated transitional provisions where any steps under the dismissal procedure have been taken prior to 6 April or where the act complained of in respect of a grievance occurred prior to 6 April 2009.
Accordingly, you could still face the draconian penalty of an uplift in compensation of up to 50% for not following the dismissal procedure or failing to spot the grievance, or worse still a finding of automatic unfair dismissal!
